FLSA Overtime Changes Finalized; What The New Rules Mean for Your Organization

The U.S. Department of Labor released the finalized rules governing eligibility for overtime pay under the Fair Labor Standards Act of 1938 (FLSA). The rules raise the salary level test for exempt workers significantly from today's current level of $23,600 per year to $47,476 – meaning that the majority of employees earning less than $47,476 must be paid overtime if they work over 40 hours in a work week.

The final rules also increased the threshold for highly compensated employees (HCEs) to an annual salary of $134,004. Organizations have until December to change their compensation plans and reclassify workers. The new rules take effect on December 1, 2016.

Melissa Sharp Murdock, Esq., is the director of external affairs for WorldatWork and is responsible for overseeing WorldatWork's strategic visibility initiatives, public policy advocacy efforts, coalition partnerships and media relations strategies. Working with the public policy team, practice leaders and association leadership, her team sets WorldatWork's legislative and regulatory position priorities aimed at influencing regulations and legislation that could affect total rewards and HR professionals in the United States. A member of the Washington, D.C., Bar and the New York Bar, Murdock has more than 12 years of experience advocating for employers in Washington, D.C. Before joining WorldatWork, Murdock worked at the National Federation of Independent Business (NFIB) in its media department and advanced NFIB's advocacy efforts on health-care reform, taxes, labor issues, legal reform and economic issues. She has been quoted in The Wall Street Journal, USA Today, ABC News, The Hill, Politico and various other publications. Prior to joining NFIB, Murdock served as Commissioner Russell Redenbaugh's Special Assistant on the U.S. Commission on Civil Rights where she gained experience working with the U.S. Equal Employment Opportunity Commission and congressional oversight committees.

Kerry Chou

Kerry Chou, CCP, CBP, GRP is a senior practice leader in the areas of base and variable compensation, performance management and market pricing. He has over 20 years of human resource experience and has worked in a variety of industries including high tech, telecommunications and transportation.

He has held several senior HR positions including Director Global Compensation and Benefits for ON Semiconductor, Senior Director Compensation and Benefits for eFunds Corporation, Director Compensation and HRIS for America West Airlines and Manager Compensation for Northwest Airlines.

Chou has been a periodic contributor to workspan and was the recipient of that publication’s 2006 Contributor of the Year Award. He has been quoted in publications such as The Dallas Morning News, Econoplay, Sales & Marketing Management Magazine and the East Valley Tribune.
