U.S. regulations require organizations to disclose specific benefits information such as Summary Plan Descriptions (SPDs), Summary of Material Modifications (SMMs) and Summary Annual Reports (SARs). Existing safe harbor provisions allow electronic disclosure of this information if certain requirements are met, and the U.S. Department of Labor (DOL) has issued a Request for Information (RFI) to learn about current practices and determine whether or not to amend the current safe harbor rules surrounding these practices. WorldatWork conducted a short survey to determine how organizations in the United States are delivering legally mandated benefits communications, and to gather opinions about existing safe harbor provisions that allow the use of electronic media in these communications.
