Administrative Exemption
🗹 The primary duty must be office or non-manual work directly related to general business operations.;;
🗹 The role must exercise discretion and independent judgment regarding matters of significance. ;
Nuance:
;This is the most litigated exemption because of the difficulty in distinguishing between employees who truly exercise high-level “discretion and independent judgement” and those who simply follow established procedures to perform routine business tasks.;
;New-collar positions often involve sophisticated software or complex processes, but employers may confuse this high skill level with “discretion.”
