Beyond Blue and White: A New-Collar FLSA Exemption Checklist
Small employers should carefully consider the duties being performed and how often they are performed before using this exemption.; ;In an attempt to reward a new-collar employee with a more prestigious job title, employers may neglect to empower them with the authority to hire and fire, which may lose the exemption.; Administrative Exemption 🗹 The primary duty must be office or non-manual work directly related to general business operations.;; 🗹 The role must exercise discretion and independent judgment regarding matters of significance. ; Nuance: ;This is the most litigated exemption because of the difficulty in distinguishing between employees who truly exercise high-level “discretion and independent judgement” and those who simply follow established procedures to perform routine business tasks.; ;New-collar positions often involve sophisticated software or complex processes, but employers may confuse this high skill level with “discretion.”
